Welcome to YNAB’s (collectively, “we”, “us” and “our”) online merchandise store website (the “YNAB Shop”)! We’re excited you’re here to hopefully make what will undoubtedly be some *spendful* purchases. Before getting into that, we have to get into some of the legal stuff here (that’s what our lawyer wants us to do!), so please read ahead.

Acceptance of YNAB Shop Terms of Service

Please read these YNAB Shop Terms carefully before accessing or using the YNAB Shop. By accessing or using any part of the YNAB Shop, you agree to be bound by these YNAB Shop Terms. If you do not agree to all the terms and conditions described here or if you cannot comply for any reason, then you may not access the YNAB Shop or use any services.

By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following YNAB Shop Terms. These YNAB Shop Terms apply to all users of the site, including, without limitation, users who are browsers, vendors, customers, merchants, and/or contributors of content. Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services.

There are several restrictions and things you’re just generally not allowed to do when it comes to the YNAB Shop—most of these may seem like common sense to some, but, we have to mention them for legal and compliance reasons.

Accuracy of Billing and Account Information

Overselling and Inventory Errors

‍All inventory quantities, availability, and pricing displayed on the YNAB Shop are for reference purposes only and may not reflect actual availability at the time of your order. We reserve the right, in our sole discretion, to refuse, cancel, or limit any order for any reason, including, without limitation, inventory errors, overselling, pricing mistakes, system malfunctions, suspected fraudulent activity, or any other circumstances we deem appropriate. Your receipt of an order confirmation email does not constitute our acceptance of your order or guarantee product availability; acceptance occurs only upon shipment of your order. If we cancel your order for any reason, your sole remedy and our entire liability shall be limited to a refund of the purchase price actually paid by you for the cancelled items. Merchandise Store Warranty Disclaimer

To the maximum extent permitted by applicable law, all products sold through the YNAB Shop are provided on an “as is” and “with all faults” basis without warranties of any kind. YNAB hereby disclaims all warranties, whether express, implied, statutory, or otherwise, including but not limited to any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, quality, accuracy, completeness, or freedom from defects. YNAB does not warrant that any products will meet your expectations, requirements, or specifications, or that products will be free from defects, errors, or imperfections. YNAB makes no warranties regarding the durability, performance, appearance, or suitability of any products for any particular use. You acknowledge that you have not relied on any representations, warranties, or statements made by YNAB beyond those expressly set forth in these YNAB Shop terms. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you in which case such warranties are limited to the shortest period permitted by law.

Severability

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these YNAB Shop Terms, such determination shall not affect the validity and enforceability of any other remaining provisions.

Termination

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

These YNAB Shop Terms are effective unless and until terminated by either you or us. You may terminate these YNAB Shop Terms at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these YNAB Shop Terms, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

Entire Agreement

Our failure to exercise or enforce any right or provision of these YNAB Shop Terms shall not constitute a waiver of such right or provision.
